By commissioning me, you agree to these terms:


TERMS OF SERVICE

I. GENERAL TERMS• By ordering a commission you agree to these Terms of Service and Privacy Policy.
• All professional correspondence (inquiries regarding my work, commissions, quotes, etc.) is handled through Twitter DMs, Instagram DMs, and email. I don't conduct business through comments or any other channels.
• I reserve the right to not accept your commission order without any reason or explanation.
• I reserve the right to decline or discontinue a commission at any time at which a full refund will be issued.
• Once a commission is completed, the payment is finalized and cannot be refunded.
II. ORDERING• Quotes can be requested at any moment, outside of wait list openings as well.
• If an order involves multiple people, all communication with the artist should be handled by a single representative elected privately by said group. All updates will be passed to selected representative only. In situations where payment is made by a different person than ordering client - all updates and communication will be handled with the representative [usually the person the quote was given to].
III. PAYMENT• First half and full payments must be made via Venmo or KoFi Stripe (PayPal only if agreed upon); upfront before work begins.
• I will start working on the commission once the payment is received and you're at the top of the queue. The queue is listed here: Trello
IV. REVISIONS, DEADLINES, CREATIVE PROCESS• Deadline, if desired, has to be communicated and agreed on before initial quote. Deadlines will affect the price if discussed and can be refused.
• Commissions will receive a sketch stage and ability to add critique to revision before being approved. Approved further work-in-progress updates are provided at the client's request.
• Changes after the commission is complete are limited to 2 small edits. Any changes beyond this are subject to an additional fee.
• Timelines and schedules may change based on health and the general creative process, clients will be updated when projects are expected to take longer.
V. IMAGE RIGHTS
• The final product is strictly for personal use. You may not sell or exchange my art in any form, physical or digital, print or NFT, under any circumstances unless you have my express written permission AND you have paid for the right to do so. You also may not use my art in any published material, even free material, on any online marketplace.
• I, the artist, retain all rights to the created artwork. I reserve the right to repost, use, show, and sell created art in digital or physical forms. Profits won't be shared.
• Clients may repost watermarked art at will as long as credit to an author is included
• I do not claim any rights to previously designed characters and other intellectual properties used in the process of creation.
• If I design your character from description or an idea you are only allowed to use the character design privately for your own use. That includes use as a personal OC to be drawn by yourself or other artists, a playable DnD character or any other use that does not include profiting off the design. You are not allowed to use the design in a game, comic or any work that will gain you a profit. Commercial rights are available if this is your goal with the design.
• Any art I create is my own. Unless exclusive rights are purchased, I retain all rights to use and monetize my art in any way I choose. This includes the sale of prints, digital products, online marketing, published materials, or any other merchandise.
• Every client has the possibility to buy commercial rights to commissioned artwork. Details will be discussed individually. Please expect industry rates and legal contracts.
VI. USE OF ART
• The client is allowed to use the art in any shape or form as long as it is for personal use.
• Edits like cropping, colour edits and other effects for DnD sessions is not only allowed but recommended so that you get full use of your commission.
• Printing the commission on products, posters or other physical items is also allowed as long as it is for personal use and not sold for profit.
• Should the client decide to change or adjust the commissioned works through the use of machine learning or derived technologies, or create derivatives of the commissioned works through the use of machine learning or derived technologies, I will consider this an automatic purchase of exclusive rights and charge the standard fee per artwork. Please inquire about the exact fee for your commission in advance.
• If the client wishes to sell the art on products, please inquire about commercial rights.
VII. OTHER
• I reserve the right to live stream on Twitch or other platforms for advertisement and record the creation of the artwork for my own record or provide education or entertainment, unless discussed otherwise with the client.
• Regarding purchased adopts, the client is free to resell them as long as they do not charge more than what the adopt was purchased for. This does not apply if the adopt has additional content made for it, in which case the client can charge more.
• The design of the adopt can be altered once purchased as long as credit is still given.
